The right should have been used preemptively to override entitlements between 1948 and 1968 as the universal human rights regime was being implemented. Instead, wealthy white families and corrupt leaders privatized the notion of family freedom, taking it out of its environmental and social context, and elevating isolation over equity to protect existing entitlements held by concentrations of wealth and empower, and to ensure those entities would profit from growth.

Regardless, share equity / self-determination is the preemptive human right, and it is protected through constitutive discourse that accurately accounts for positionality, and a binary redirection of each of our abilities to influence the world so as to first empower the most vulnerable – future children and their nonhuman ecologies, which is the thing that makes the freedom of inclusive democracy and any obligation to follow the law possible.

An ecosocial fair start in life is also the standard for evaluating legal damages for the many crises unfolding today, including the rampant impact fraud hiding climate liability, and it is the preemptive standard for all law and policy to resolve the damages.

For most, fair start just means doing what they are doing, but orienting from a position where they do not benefit at cost – often deadly cost – to others, and undo the good work we otherwise do in the world.
