The Most Effective Public Interest Work You Can Invest In

The Fair Start Movement arose from a growing body of undisputed research that traces the climate and political crises we all face to a very specific mistake, made decades ago, in reproductive rights policy making.

Because we collectively used a false assessment and reporting standard disconnected from accurate measures of ecological and social harm, we never assured children birth and development conditions consistent with their rights. This allowed enough inequitable growth to degrade our ecologies and disenfranchise the average voter, leading to environmental catastrophe and the concentration of power in a few.

Fact: As we show in this work re-published Stanford University, violating children’s rights, and assuming children of color deserved a fraction of the  resources and exponentially more risk did more harm to all of our values – like moderate temperatures, food security, and representative government – than any of our philanthropic efforts did good.

The fix? All must admit that truth, and now back a universally preemptive and restorative standard that treats the old standard as illegal, and reallocates resources into equity-based family reforms that encourage parenting delay, readiness, and child entitlements inverse to their parents wealth.

More specifically, we are bringing legal actions before states attorneys generals in the United States urging key target organizations making claims of beneficial impact to disclose how they were accounting for children entering the world in their claims for the last three years.

We believe that contrasting claims with the facts of declining infant and maternal health will show continued use of the illegal standard, which in many cases will give rise to legal liability for inaccurate claims leading to the deaths of millions. There is no universe in which impacts, taken out of context from their relative position to birth equity, occurred. Use of such-out-of-context claims hides the fundamental driver for the deaths: Enabling the powerful over the vulnerable.

We should not let those who benefitted from the illegal standard escape justice.

  • Vox’s Coverage of the Climate Crisis, Oligarchic Threats to Democracy, and Animal Rights Does More Harm Than Good. Act.

Vox’s Coverage of the Climate Crisis, Oligarchic Threats to Democracy, and Animal Rights Does More Harm Than Good. Act.

If you comb through coverage on the Vox news site regarding a variety of issues – including the environment, population, democracy, animal rights, etc. – you will see something odd.

They never trace all of these problems back to the source: Unsustainable and inequitable family models that exploit future children for economic growth. Each day those models make the problems being covered worse. Like most concentrations of wealth and power the news outlet’s values do not outweigh their desire to exploit growth and their own birth positionality, even when that exploitation drives a deadly climate crisis. And even when doing so makes their coverage hypocritical.

Fact: Our collectively violating children’s right to a fair start in life, and assuming children of color deserve fewer resources and more risk, has done more to harm our values and missions than we have done to further them.

A hazy, polluted city skyline with the quote: Explain to future generations that it was good for the economy when they can’t farm the land, breathe the air, or drink the water. - Unknown. Having Kids logo at bottom.

Wealth in the world today was made through growth and at cost to children’s rights, in what some call the #famscam. In the scheme, nations illegally evaded their obligation to only bring children into birth and development conditions compliant with children’s rights and the political equity from which legitimate governance derives.

They chose a form of unsustainable reproductive autonomy that was akin to the racist separate but equal scams, but one which will kill far more persons. Governments said we were equal and then ensured some children had nothing and others everything under the lie that parental autonomy could exist outside of political equity.

Infographic titled Inequality and the Climate Crisis: How did we get here? with text blocks explaining causes like prioritizing economy over rights, disenfranchisement, ignoring the 1/10th wealth gap, and impacts on families. It also highlights how practices such as legitimacywashing contribute to the problem by masking systemic failures under a veneer of responsibility.

Because of the crisis we owe children and future children reparations based on zeroing out our harming them, using at least eight metrics to assess what we owe.

Anything that starts with less is inherently oppressive and non-inclusive. People, rather than documents, constitute nations as they are born, raised, and emancipated. What we think of as growth is actually political inequity.  We have an overriding or preemptive right to take the wealth that was stolen and use it to fund family reforms, or the constituting of a just future.

Those who subverted the civil rights movements decades ago, by ignoring children’s rights in the idea of reproductive autonomy, were avoiding the override – the fact that political equity always comes first and would allow the needy to take the correct resources by all means. National borders, rules and entitlements derive from the sovereignty or self-determination of constituents, and that derives from relations developed in birth, development and emancipation.

Top Down Power and Bottom Up Empowerment

The many funders that framed and defined social justice over the last several decades never created real value in their vast wealth, relative to an objective standard like a healthy climate. Instead they first used inequitable family planning to create their own audiences and artificial demand by ensuring dismal standards for child development and education, violating their own professed values (like animal protection and children’s rights) and treating people as economic inputs rather than citizens.

They did this while benefiting from the appearance of inclusive and functional democracies where the average vote was actually being diluted to uselessness. A system of fundamental entitlements likely to kill millions of innocent persons, and which could instead have achieved better outcomes by actually investing in children, is generally considered a failure.

Two illustrations compare family planning models: At left, a diverse happy family stands together with icons for community and health. At right, a monochrome crowd in a city. Text contrasts fair start (rights-based) with economic growth-based planning.

The baseline those like Vox uses has subverted the civil rights and anti-apartheid movements by undoing with family inequity upstream the good they seem to be doing downstream – a move that exponentially catalyzes the climate and related crises, while aiming the harm of the crises towards the least responsible for it, and most vulnerable to it.

If the Three-Fifths Compromise in U.S. history fractionalized the worth of persons of color, the one-tenth and greater illegal disparities in generational wealth that violate legally enforceable children’s rights regimes will now mean the death of millions of children of color in a climate crisis caused primarily by white wealth.

Wealthy, mostly white, families and other entities are now funding charities, media, politicians and academics who silo social justice issues away from birth equity, and use omissive messaging – a form of entitlement and impact, or equity, fraud –  that hides their liability and the  illegal macro entitlement systems ensuring the death of millions as the climate crisis accelerates. Fraud is intentionally benefitting at harm to others based on misinformation, including omissions.

Exploiting mothers’ vulnerability to ensure growth, and not first ensuring reparative family reforms that assure children birth and development conditions consistent with the Children’s Condition, does more harm to all of our missions than we are doing good, because the power dynamics that choice creates is degrading the ecological capacity of the planet to ensure infant health – the first and only measure of value.

  • The Basic Mistake Driving the Climate Crisis

The Basic Mistake Driving the Climate Crisis

The book Winners Take All helps us understand how philanthropy over the last decades failed in ways that ensured the climate crisis.

But author Anand Giridharadas, @anandwrites, misses the most salient example of the failure:

How we collectively violated children’s right to a fair start in life by not using the Children’s Convention as the standard in family planning regimes. Instead, under the veil of family privacy, we assumed children of color deserved fewer resources and more risk. That did more to harm all of our values and missions than we did to further them because the power dynamics that choice created degraded the ecological capacity of the planet to ensure infant health – the first and only measure of value.

Ask anyone claiming to add value to the world how they are accounting for children entering it, and whether those claiming to add value are more likely to 1) assure minimum levels of welfare, or 2) exploit a lack of protection to benefit from growth-based investments.

You will likely find the value claimed being undone every day as children enter into conditions that do not ensure what those kids need, and at levels that degrade their environments and disenfranchise them politically. Make sure to measure the harm from a zero baseline that captures all the harm, and not the narrow metrics that caused the crisis.

Violating Children’s Right to a Fair Start Did More Harm Than Pew Trusts Has Done Good. Act.

A recent article has quoted Pew Trusts on the threat smaller families and eventual population decline pose to our future.

That hides the fact that the organization for decades has violated most of its mission parameters by relying on unsustainable and inequitable growth models that are killing millions while enriching those behind the organization.

World Population vs. Global Anthropogenic CO2 Emissions

The Fair Start Movement begins with the fact that wealth in the world today was made through growth and at cost to children’s rights because for decades nations illegally evaded their obligation to only bring children into conditions compliant with children’s rights. Anything that starts with less is inherently oppressive and non-inclusive. People, rather than documents, constitute nations as they are born, raised, and emancipated. We have an overriding or preemptive right to take the wealth that was stolen by using extractive growth to override children’s rights, and use the wealth instead to fund family reforms, or the constituting of a just future.

    A Key Barrier

Many entities in those nations most responsible for the climate crisis are using the same fraudulent impact assessment and reporting standards, ignoring how children entering the world without what they need undoes sustainable development impacts, that drove the crisis. They are hiding their liability for the death of millions.

All climate reparations must be based on measurable and collective self-determination. There are no values outside of that system, given climatological impacts on infants.

Moreover, language matters, and we cannot be free or contextually self-determining without constitutive communications that reflect our most fundamental obligations to others – starting with children that would enter the world. There is no such thing as an inclusive, representative, and hence legitimate legal system without those communications.

The Tell the Truth (TTT) Campaign

Justice starts with speaking the truth, and neutral fact checking from a zero harm baseline.

The TTT campaign allows everyone to relate their experiences to the reality of the most vulnerable, children entering the world, impacting vulnerable animals, in the actual first creation of unjust power relations, rather than relating those experiences to decoy points (politicians, celebrities, advertising, etc.) created by the powerful. All legal obligation derives from language, and ours should mutually empower – not disempower – at the base.

Fair Start is pursuing legal action to ensure a three year omission disclosure requirement of how formerly undisclosed growth impacts 1) compounded children’s rights violations relative to an actual baseline of harm, 2) increasingly degraded ecosystems, and 3)ensured massive political disenfranchisement.

We have a right to know what entities are doing to the physical capacity for all to self-determine and be free, so those entities can be held accountable.

Pew Trust lead Susan K. Urahn should admit that not prioritizing a fair start in life for all kids did more harm to the Trusts’ missions than the Trusts did to further them.

Anyone claiming to add value to the world must disclose how they were accounting for child entry factored in their value assessment. Were they measuring, assessing and reporting public interest impacts / outcomes based on standards meant to take oneself out of one’s birth and development context, ensuring children of color were treated as deserving less and placing them at increased risk – and now, at high risk of dying in the climate crisis?

How much of the claimed beneficial impact by the Trusts has been undone in the last three years through growth?

  • A Story About Deadly Privilege: Why the World Needs Fair Start Reforms

A Story About Deadly Privilege: Why the World Needs Fair Start Reforms

Violating children’s right to a fair start in life, or what they are owed under the Children’s Rights Convention, has done more harm to public interest efforts than any organization has done good because 1) it has allowed inequitable growth – the greatest driver degrading the capacity of the earth to ensure the thriving of human and animal life. And 2) we all managed to do that, to exploit growth rather than invest in children, by treating children of color as deserving many fewer resources and much more risk.

We don’t get to justice from injustice, or earn obligations from others by ignoring your obligations to them. The solution? We have to accurately derive, state and comply with our first obligations: To actually empower children as they come into the world so that we live in a democracy, and not just an economy.

A friend and I consistently debate environmentalism, He was born into a wealthy, white family, and enlarged that wealth by holding real estate, the value of which increased because of growth-based demand in California. He has also invested in artificial intelligence systems that use illegal code that degrades democracy by promoting political obligation without assurances of political equity.

His wealth – made at horrific environmental cost to mostly children of color –  allows him not to work, and to elevate his own children’s choices in life even as other children are born into early deaths. That wealth allows him to travel – even enjoying access to private surf locations local surfers could never afford. He was recently able to surf an artificial wave pool while traveling, which is an environmentally damaging system that allows wealthy investors to profit by replacing something natural, and at deadly cost to vulnerable communities.

In essence, he won a birth lottery that ensured him a life of ease fundamentally built on costs to others, and he favors conservative environmental nonprofits that do not interfere with the fundamental process that will allow him to ensure his eco-social privileges to his children.

    Inequality info graphic

When he learned about Fair Start he urged me to focus on getting officials to agree to the standards we promote rather than treat them as fundamental, because that immediately assumes their authority and his entitlements. He knows how to decoy from questions of fundamental entitlements, white wealth, and the first drivers of all outcomes towards existing systems of “justice” controlled by the same false assumptions that ensured the climate crisis.

I could be more culpable than my friend. I worked as a public interest attorney for both the federal government, and many nonprofits, all of which used the same illegal assessment and reporting standards (which in essence, are just forms of language) that caused the climate and political crises we see in the world today. I was using the same standards as my friend, standards enabled by removing political equity from reproductive rights regimes decades ago in efforts to subvert Twentieth Century racial justice movements, a move that more than any other one thing has exacerbated the climate and related crises we see today. In essence, by privatizing family planning, and at the most fundamental level, it created a false version of freedom – on that covered all senses of that value – by taking it outside of the context of one’s political equity or effective share in one’s political system.

That move obscured the most basic rule that determines whether we are free, in violation of every metric one can imagine, from protecting children and the environment to assuring each person some level of influence in their democracy.

    Climate crisis infographic

In my public interest work I performed a horrible magic trick: I and others with influence used a fundamental set of assumptions, entitlements, and authorities – standards – in which I received a goodwill increase in my reputation from the work, more money in my accounts, and yet the vulnerable I claimed to represent are now all worse off.

And I mean worse off in terms of the measurably outcomes that underlie things like the laws that deal with children’s rights, animal rights, and civil rights. In all categories, the entities those laws seek to protect are worse off as heat rises, democracy declines, and the distance between the wealthy and impoverished widens.

My friend and I used the same standard that caused the crisis to hide liability for it. He is many things, many of them good. But this is the dilemma of the dysfunctional family system we have all inherited: He benefits at deadly cost to others, and chooses to continue that way in his life. That, in a fundamental way, is who he has chosen to be.

There is an ecosocial baseline children need to experience value, and their birth and development itself can alter that baseline in a way that harms infants’ needs. That baseline is the objective measure of our value, relative to others. There are no values outside of that system, given climatological impacts on infants, and infant/human health as a basis measure of all value.

A comparison chart of Current Family Planning vs. Fair Start Family Planning. The left side lists negatives of current planning; the right side highlights positive outcomes of fair start planning for welfare, equality, and environmental protection.

    Is there a fix?

Fair Start reforms begins simply with our admitting that the wealth in the world today was made through growth and at cost to children’s rights because for decades – in what we might call the #famscam – nations illegally evaded their obligation to only bring children into conditions compliant with those rights. Anything that starts with less is inherently oppressive and non-inclusive.

People, rather than documents, constitute nations as they are born, raised, and emancipated. We all have an overriding or preemptive right and obligation to take the wealth that was stolen by violating children’s rights and use it to fund family reforms, or the constituting of a just future defined by actual relations, not some abstraction.

An Open Letter to ReproAction and the Center for Reproductive Rights: Abortion Rights Can Override Governmental Authority

That standard – a demand for family planning resources to ensure children’s rights, the right which are the most basic standard for who our species should be – is the key to mutual self-determination, or freedom.

Many entities in those nations most responsible for the climate crisis are using the same fraudulent impact assessment and reporting standards, ignoring how children entering the world has undone sustainable development impacts, that drove the crisis in order to hide their liability for the death of millions.

The charities my friend supports use those standards.

Challenging assumptions that hurt our future infographic

The Tell the Truth (TTT) Campaign: Justice starts with speaking the truth, and neutral fact checking from a zero harm baseline.

The Fair Start Tell the Truth campaign just asks one question of those like my friend.

If you have claimed to create market value, public interest impact, or to exercise authority as government officials or holders of wealth, please explain how were you accounting for children entering the world relative to their rights and especially to measurable levels of political equity? Just the same way we have equity in a company, we have equity in your democracy. Your share depends on how many others are in it, the varying levels of influence they have, the impact on the environment around the democracy, etc.
We ask this question in the Tell the Truth campaign: How did you account for these things when you made your claims of impact?
We can ask other questions. Would my friend be willing to say that his entailments to his wealth, and the authority of government to use force to protect him and it, derive from and are conditioned on ensuring birth equity for all children? Would my friend change the standards, and elevate birth equity above bodily autonomy and economic growth in reproductive rights regimes, if he could go back in history and do it? Would he choose to sacrifice some of his wealth in exchange for saving lives if he could go back and do it?
Top Down Power and Bottom Up Empowerment infographic
The answer is my friend and others were not accounting for such things, because no one ever told them that any measure of value and impact, of governmental authority and entitlement to wealth, starts with empowering people.

The Tell the Truth campaign goes beyond deferring to the will of others, and into the dignity of fundamental rights and obligations, and what we all owe. It allows everyone to relate their experiences to the reality of the most vulnerable: Children entering the world and impacting animals in the actual and first creation of unjust power relations, rather than relating those experiences to decoy points (politicians, celebrities, advertising, etc.) created by the powerful.

Fair Start is now pursuing legal action to ensure disclosure requirements – from companies and charities – detailing how growth has compounded children’s rights violations, increasingly degraded ecosystems, and ensured massive political disenfranchisement.

The Fair Start Movement was formed as the world’s first constitutional watchdog to engage in fundamental fact checking, scanning for use of the same fundamentally illegal standard of entitlements that caused the crisis by those who would choose to avoid liability for the crisis, and to evade the life-saving and legitimating reparations they owe. Our tactic is simple: We take impact claims made by influential entities and key public interest organizations and we assess them against objective measures of ongoing losses of political equity and democratic influence, or a zero-baseline measure of the full spectrum of harm caused by the crisis. Fair Start does not replace downstream public interest interventions; it reorients them from preemptive, rights-based, legitimating, and upstream base.

Under the Fair Start Tell The Truth campaign, we ask questions to bifurcate key influencers into the fair and unfair, and in the latter identify key barriers who should  disclose how much of the value they claimed to create has been undone when we factor in violations of he rights of children and animals. We contrast impact claims that use the illegal standard that ignores harm to some children with actual harm to all children, relative to a zero baseline, or the neutral standard necessary for a coherent base value of being free.

Language matters, because it would be physically impossible to be free without accurately premised communications that capture how we fundamentally become legally obligated to others as they enter the world, and we are preemptively obligated to communicate in accord with that obligation be self-determining.

We have a right to know what entities are doing to the physical capacity for all to self-determine.  We are either included in a system of rights, which must include children’s rights as the base, or we are not. Those of us who are not could never justify why basic obligations are owed, given that they do not extend them to others. . The disclosures discussed above can ensure correctly assessing who chooses to be free or self-determining, and who chooses to exploit their positionality at deadly cost to others and thus fall outside of any logical system of liberating mutual protection.

    Take action:

All should admit that our collectively not prioritizing a fair start in life for all kids has more harm to our values and missions than we have done to further them. And we should take action to reverse that mistake, and elevate children’s birthrights as the first and overriding human rights.

You can urge the United Nations to do so here.

There is an analogy for the shift that is needed: All work is done on a floor that is falling apart, and some want to keep going while others fall through, clutching at others and dragging them down as they go. These free riders threaten us all. Why? It is physically impossible to be free, as in self-determining, if we don’t use accurately obligatory language – a new standard – to ask and then assure that persons are created, developed and emaciated in ways that offset equally their capacity to influence political systems equally, relative to a neutral position or objective standard for evaluation.

If we do not invest enough in children to offset their capacity to influence relative to zero, then political representatives and officials are not that at all, and constituents are not being empowered equally. The creation and entry of others does and should fundamentally shift our obligations, and freedoms. Without Tell the Truth, without this inversion of obligation in the language that inevitably determines how we relate to others, those entering the world are either not empowered, or we all have no choice but to be subjected to their power and influence – including the degradation of the environment around us. We should instead empower the governed, not the government and the wealthy. And it’s very hard to change a future child’s prospects once they are born, so justice should focus on thresholds beneath which children should not be born.

Martha Nussbaum is a leading thinker on matters of justice, including justice for animals. But she never accounts for the a primary obligation to create just and mutually empowering relations, in the actual birth, development and emancipation of the humans who will interact with nonhumans. How does justice, without that need being fulfilled, benefit animals? It can’t, and Nussbaum is disoriented – using a version of “separate but equal” policy that undoes in birth inequity the beneficial impacts she seems to want, while enriching mostly white kids at deadly cost to countless children of color.

She remains so until she takes account of the primacy of her positionality, and acts on it.

We can’t get to justice, legitimacy and an obligation to follow the law from the injustice of violating children’s birthrights and assuming children of color deserve exponentially less resources and more risk. Doing that has done more harm than we did good. How? Exploiting mothers’ vulnerability to ensure growth, and not first ensuring reparative family reforms that assure children birth and development conditions consistent with the Children’s Condition, does more harm to all of our missions than we are doing good, because the power dynamics that choice creates is degrading the ecological capacity of the planet to ensure infant health – the first and only measure of value.

At the end of this post we ask her to prioritize intergenerational justice, not as an issue siloed from her animal work, but as the correct basis for it.

    Introduction

The climate crisis is intensifying, and killing millions who had little role in causing or exacerbating it. At the same time a small percentage of persons have become obscenely wealthy. Many are asking if there has been a fundamental failure of justice – in the actual creation, at birth, of power relations – that we should all address. Many entities in those nations most responsible for the crisis are using the same fraudulent political systems, and impact / reporting standards, that caused the crisis in order to hide liability.

Fact: The failure of world leaders for decades to ensure a measurable fair start in life, both ecologically and socially, for all children has done more to harm the practice of justice than Nussbaum and other luminaries have done to further it. There is no form of justice, and certainly not animal justice, that ignores the actual creation of human and nonhuman relations. And it’s very hard to change a future child’s prospects once they are born, so true justice first focuses on thresholds beneath which children should not be born. Most thinking about that threshold seems focused on welfare. But if we use a metric or value like self-determination, the idea of intergenerational justice actually becomes a the first necessary condition for political obligation, the first rule, or what is required to owe others our allegiance to a legal system. Nothing is more primary than our birth-determined relations to others.

When the reproductive rights regime was developed and put into law, the architects conflated the acts of having kids and not having kids equally as a matter of parental bodily isolation. But creating a child is the least isolating thing one can do – it’s interpersonal in nature, not personal, and it is in fact the basis of our relations – it’s constitutive: https://mahb.stanford.edu/blog/family-planning-offers-the-best-means-for-combating-climate-change-an-interview-with-carter-dillard-fair-start-movement/.

Autonomy as isolation, out of context, was effectively an extension of the racist “separate but equal” thinking at work at the time.

Nussbaum’s work ignores this primary issue – the largest determinant of animals lives.

This is a failure many funding the fields of animal law and justice are eager to ignore because they made their wealth on the growth and inequity that together are killing many as temperatures rise. Climate change and inequality are interconnected crises that disproportionately harm the most vulnerable, requiring immediate, systemic action. This is not a choice on a menu of public interest interventions. This work relates to the inescapable system of costs, benefits, and obligations we are all born into, the largest driver of outcomes, and the choice to exploit that system or legitimate it.

World Population vs. Global Anthropogenic CO2 Emissions

    Human Population and extinctions infographic

How did Nussbaum, in her work, account for how children entering the world impacts nonhumans? This is not a complex question. Where in her work does she account for the injustice of her birth positioning, derived from a form of isolationist reproductive autonomy devoid of racial or nonhuman equity? Did her drawing attention to downstream forms of justice, while ignoring the fundamental role of inequitable growth, decoy efforts away from effective work, and exacerbate situations like heat exposure combined with racial disparities in access to air conditioning?

There is no universe in which beneficial impacts, taken out of context from their relative position to birth equity, occurred. Use of such-out-of-context claims hides the fundamental driver for the deaths: Enabling the powerful over the vulnerable

Fair Start is writing Nussbaum openly for a reason

For years Fair Start activists had been encouraged to engage in private academic discourse and debate about our work while also assuming and benefitting from default systems of birth entitlements (like white wealth), protected by the violence of the legal system, that were contrary to the ideals of animal justice.

That backchannel and time consuming discourse is what one might call distracademia. In light of the immediate horrors of things like growth-exacerbated heat waves, much in the modern animal protection movement – like the academy and its questionable impact – seems more like a self-aggrandizing garden club that has been funded by the clear cutting of local forests than drivers of a true social justice movement.

At a meta level, beyond the façade, is Nussbaum assuming entitlements she should not?

Liberalism, and freedom, mean being empowered. How could that possibly happen outside of the context creation, development and emancipation? Are academics exempt from this relative positioning? Those who reject fair creation obligations limit themselves to a version of freedom that is leading to the death of others. Why not change the entitlements default while engaged in the discourse to avoid that? Would Martha have focused on this change, decades ago, if she had known how the climate crisis would unfold?

It’s very possible we should define fundamental political group membership, and the deserving of collective protection, based on the level of protection members would extend to infants and animals. Those rejecting self-determining protections for these vulnerables through things like parental delay and readiness incentives would themselves fall outside the scope of being owed protection because there would never be a way to explain why they have shown the reciprocity necessary for membership. They are not included in any collective “we.” Deserving that, being included in a legitimate system, is not onerous and could just require backing high level birth protections for infants. For those who do not, it’s unclear why they deserve basic protection in political systems which are, at base, premised on inclusion.

That is all we are asking Nussbaum to do – to consider resetting the default for obligation, and protection, while she engages in discourse.

There is an analogy for the shift that is needed:

All work is done on a floor that is falling apart, and some want to keep going while others fall through. These free riders threaten us all. Why? It is physically impossible to be free, as in self-determining, if we cannot ask and then assure that persons are created, developed and emancipated in ways that offset equally their capacity to influence political systems equally, relative to a neutral position or objective standard for evaluation.

Those entering the world are either not empowered, or we all have no choice but to be subjected to their power and influence – including their degradation of the environment around us. We should instead empower the governed, not the government and the wealthy.

All evidence suggests that not ensuring all children a measurable fair start in life, and birth and development conditions consistent with the Children’s Rights Convention and the Human Right to a Healthy Environment, has done more to harm all social justice goals, including individual freedom, than any other efforts have done to further them. In many cases when one factors in loss of political equity, or one’s effective shares in democracy to control the influence of others, many public interest organizations have spent more on lavish travel and events than furthering their missions.

But we don’t talk about this because it means admitting the historic subversion of civil rights through family inequity, and the treating of children of color as deserving a fraction of what white kids deserve, while assuming those children of color should suffer the brunt of the climate crisis. The wealth we see in the world today carries massive debt because we all benefitted from the violation of children’s rights to make it, bringing children into the world as means and not rights-bearing ends.

Whatever Nussbaum said, she lived a life of benefiting from not having to assure her own values in the birth-creation of others’ power relations, for example, in the funding that would have backed her work. All of that wealth would have been made in disregard of the lives of animals and the most vulnerable children because their interests are absent in the fundamental family creation norms that entitle wealth.

Nussbaum clearly avails herself of the benefits of our legal system, to protect herself for example, without deriving that system back to, and conditioning its legitimacy upon, measurably empowering those subject to it. That is the problem – one the impacts the freedom of others in a way that calls for a reaction.

Abstract academic debates about ethics, often funded by concentrations of wealth and power reliant on inequity and growth, threaten to exacerbate the results of the climate crisis by forestalling law and policy reforms. Many of the debates derive from the same Eurocentric vestige of colonialism described above – the historic entitlement of wealthy families to exploit birth positionality relative to colonized nations – nesting in the human-rights regime.

Academia should be objective and that doesn’t mean ignoring one’s positionality. It actually means first accounting for it, especially to avoid contradictory exploitation and entitlements that conflict with one’s values.

Most of the academics in these debates contradict in their writings the basic values they exhibited throughout their lives, e.g., 1) seeking minimum thresholds of personal welfare while letting at risk children and certainly many members of future generations die in infancy through deprivation and abuse that could have been avoided; 2) expecting equal access to opportunities while the exponentially discriminatory birth positioning of others resign them to a life of servitude, 3) participating in and adhering to political/legal systems that purported to represent the governed while ignoring the way dilution and positionality ensure the voices of some carry no weight, 4) using and enjoying an environment relatively conducive to human and nonhuman health while others are born into the deadly results of racist ecocide, and 5) enjoying a right to have a child in relatively safe conditions while others and those in the future have no such option, etc.

You can identify these academics because they will avoid discussions of how shared values relate to the actual creation of power relations. They will pontificate on values while enjoying the benefits of their birth lottery outcome.

They will silo off values, like animals’ rights, from the issue of who the humans – the performance of which those rights depend on – should be. They will avoid discussions of their full positionality. They will avoid explicitly conditioning state authority on empowering each person equally.

If the micro-liberation of nonhumans looks like open rescues at factory farms, the macro would look like “real new deal” social contract demands for reparations in exchange for child-centric planning that would ensure a truly climate-restored and bio-diverse future in which humans are empathetic enough to be inclined to treat nonhumans well. But many academics, whose interests do not align with macro reforms, ignore the latter.

Abused animal tied to a fence

These academics often assist funders in coaptating the values, imitating and redefining things like animal rights and mutual self-determination of humans and nonhumans, creating something that looks like the value but more aligned with their interests.

Fair Start has shown that a necessary condition for something to constitute “animal law” would be that it can actually benefit nonhumans, including accounting for the creation – through our birth and development – of their relations with humans. There are influential funders in this space however that define the field to specifically avoid that issue, going so far as to selectively report developments in the field to hide the way macro forces like growth undo the value of granular “victories” at a macro level. This benefits the funders, and wealthy their kids, as deadly cost to nonhumans and mostly vulnerable children of color. Both Nussbaum and the funders have affirmed their views of animal law and justice in this regard, with Fair Start activists in communications the activists can provide.

Our language, by not including the impact children entering the world has on our values, work, and missions, hides costs we foist on others and blocks our ability to derive obligations to follow the law back to a condition of its actually measurably empowering those subject to it. The hiding means we value the things in our lives by taking the idea of self-determination out of context, ignoring how our lives very much determine others – climatologically for example. At a subject-subject level of animal liberation, it would not mean that we have social contract obligations with nonhumans as voters or contractors. It would means that their presence influences who the human persons we share our democracy with are and should be. That’s what matters to nonhumans.

As discussed below, one solution is to legally require disclosures contrasting claims about values with the actual ecosocial baseline children need to experience value, and how their birth and development alters that baseline in a way that harms infants’ needs.

We have all benefitted at deadly cost to future generations, a fact quickly manifesting now as the climate crisis intensifies.

None can be allowed to ignore creation ethics / positionality. Where, when and with which resources we are born is the largest determinant of outcomes in things like the climate crisis. And in terms of justice, and political obligation, there is no more basic a choice than how to deal with and offset our creation positionality, and the benefits and costs it conveys, intergenerationally for example.

Infographic comparing Top Down Power vs. Bottom Up Empowerment for birth equity, listing social impacts of each approach—including potential risks like legitimacywashing when using top-down strategies. Includes icons of people, scales, graduation cap, and supportive hands.

Our collective failure to deal with the unjust and unsustainable system of growth that created our own birth, developmental, and emancipatory positionalities is leading to the death of millions. Academics are not immune from this systems of benefits and costs. In fact leaders in the academy are some of the most responsible given their decoy effects.

We should all admit our benefitting at deadly cost to others based on never ensuring all children the fair start in life justice required. Doing so now, and changing policies to internalize the costs we foist on others, can save lives. Doing so would allow us to require fundamental social coordination around a norm which is infinitely easier to use than a written constitution of the sort we have in the U.S., a thing unknowable to most – and more backed by guns than collective reason and understanding.

Challenging assumptions that hurt our future infographic

Nussbaum’s work and claims contain the same self-serving baseline error as the work of Cass Sunstein. Instead of self-determination in the accurate sense, law and policy forced our thinking into an immediate focus on other humans that veiled our creation. How? Again, our legal and political systems treated having children as an act of autonomy, bundled up with the act of not having children, because that form of autonomy would define the concept of power in a way that avoided questioning certain entitlements.

The dangerous and powerful were the men with guns in government, and the castle of the home was an autonomous zone to be protected from it. That’s not the definition of the conception of power that makes democracy work. Power is any form of human influence, the mass aggregate of human activities that is killing millions in the climate crisis, and it begins as we—and our relations to others—are created fundamentally through birth and development. Watch for others entering the world, not the leaders with money and guns they will become.

    Equity graphic

This was power over others, not self-determination for all, and the misconception mainly operated by taking the element of time out of the equation and assuming certain relations rather than requiring birth and developmental self-determination. However, families are not just part of the social contract but constitutive of it.

Instead of racing others to the bottom for how bad we can act or be, the natural and temporalized threshold for being is based on hard metrics linked to physical conditions in the world, and it is much easier to see and achieve in a collective setting, like care modeling, than a nuclear family. This is a binary choice between acting obligated towards bottom-up systems of investment and inclusion, or top-down systems of governmental violence that exploit low levels of child welfare to create growth that kills animals and destroys nature.

One chooses higher climate and related damage assessments (on eight levels at least) based on true freedom or lower assessments that continue the powerful determining the vulnerable paradigm. The former is the standard for terms like “green/sustainable,” “democratic,” or “inclusive” that would have saved those dying in the crisis. The latter is the standard wealthy investors use to make money.

But as the climate and relate crises worsen, there are fewer reasons to continue to make that mistake. In essence, if we do not change the standard, we are inclined to “double dip,” to ignore birth positionality – the fundamental system most driving the outcomes, the main determinant, while pretending we are saviors ensuring justice. The Fair Start, “Tell the Truth,” theory of change takes claims each of us have made that assumed state authority and wealth entitlements not conditioned on the actual empowerment of constituents, has us admit those claims were fallacious, and urged us to now commit to elevating the empowerment threshold as an obligation above state authority.

This mimics some of the truth and reconciliation work in other contexts, but with future children.

Nussbaum is a luminary. She is also a person who simply benefitted at deadly cost to others, as many of us have. She can be a leader in fixing the fundamental cause of that. Martha will have air conditioning this summer. Some infants near her in Chicago will not.

TAKE ACTION: Contact Nussbaum and urge her to admit the harm done, and back concrete reforms in human rights law that would ensure all children a fair start in life as the first and overriding human right.

For example, we could ask whether she would consider who – between wealthy families uniquely responsible for the climate crisis seeking to defend their wealth, and impoverished would-be mothers needing resources to defend their future children’s choices in life, would have a superior claim to use state violence?

Professor Michael Sandel is a leading thinker in political philosophy and justice, and his work has helped define the field.

But as the climate crisis intensifies and kills millions who had little role in causing or exacerbating it, and at a time where a small percentage of persons have become obscenely wealthy, many are asking if there has been a fundamental failure of justice that we should all address.

Fact: The failure of world leaders for decades to ensure a measurable fair start in life, both ecologically and socially, for all children has done more to harm the practice of justice than Sandel and other luminaries have done to further it.

We have all benefitted at deadly cost to future generations, a fact quickly manifesting now as as the climate crisis intensifies.

Ask anyone claiming to good work in the world to account for children being born without what the Children’s Rights Convention promises those kids in resources and rights. Then ask the person claiming to do good to reassess their claims. You will see a lot of good that many claimed to do actually fall away, by metrics we all believe in, with harm escalating as temperatures rise.

What is a Fair Start in Life?

Sufficient funding that ensures no child is born beneath a set level of entitlement, consistent with the Children’s Rights Convention (“Convention”) and Right to a Healthy Environment, is exponentially the most just and effective way to protect our future and free all of us. The creation of power relations – through birth, development, and emancipation – is usually the biggest driver of social justice outcomes because it operates on many levels, compounding impacts simultaneously.

Infographic comparing Top Down Power vs. Bottom Up Empowerment for birth equity, listing social impacts of each approach—including potential risks like legitimacywashing when using top-down strategies. Includes icons of people, scales, graduation cap, and supportive hands.

We can ensure that funding by using the extreme wealth in the world today to fund reparative justice, wealth that was made by not paying the costs of avoiding climate, autocratic and other harms to future generations. The legitimate and reparative standard – being fair – will save millions of lives, and trillions of dollars.  However there are entities now funding charities, media, politicians and academics who silo social justice issues away from birth equity, and use omissive and fraudulent messaging that hides their liability and the entitlement systems ensuring the death of millions as the climate crisis accelerates.

This is, in essence, the fraudulent withholding of reparations using a historically racist and unsustainable model – not benchmarked to actual harm – that illegally bypasses children’s rights as the basis for reproductive intergenerational justice. This is an arbitrary model that simply assumes children of color are worth less in terms of the birth and development conditions they deserve. That assumption will now condemn millions of children, mostly of color, to death as the climate crisis intensifies. Fair Start outs those using the fraudulent standard, which is inherently omissive, by simply asking targets to account for the entry of children into the world relative to things like the Convention when making impact claims and to adjust their claims accordingly.

Challenging assumptions that hurt our future infographic

The results are often shocking, with many public interest organizations having spent more on lavish travel, events and other performative things than on furthering their mission. Fair Start assists communities impacted by the fraud to seek claw-back reparations.

We can even focus on the harm from the fraud itself as a trimtab lever, and linguistic model, for larger systemic change and the physical constituting of legitimate relations through accurate language of obligation and the changes in behavior that follow it. The funds from this process can then fund changes in the existing sexual health and reproductive rights field that would treat mothers and infants as the priority class among vulnerable entities under civil rights laws.

  • Fair Start Fact Checking Animal Rights Philanthropist Brad Goldberg. Take Action.

Fair Start Fact Checking Animal Rights Philanthropist Brad Goldberg. Take Action.

The field of animal law, rights, and protection has been around for a long time. It is one of the most aspirational areas of justice, aiming to protect and liberate nonhumans from the horrors humans inflict upon them. But as the climate crisis unfolds, and more animals are harmed each day by humans, we should look for what must have gone wrong in the field to bring us to today.

Brad Goldberg has been one of the most influential figures in the field of animal rights and law, having used his wealth to in a definitive way, funding and advising organizations, academics and activists for decades. He seeded animal law programs at some of the leading schools in the nation, and has written extensively about funding and activism for animals.

He funded much of the work that today is considered “animal law,” much of which is based on assumptions about legitimacy and human rights that allow investors (like Brad) to make money on growth-based markets that do more harm to animals than any granular reforms do good.

But if one closely analyzes his public statements, his giving, and the results of his giving, something foundational is missing. He never seems to account for how children entering the world, and the very different resources they have when they do, impact the lives of animals.

That’s not ideal, given that is the largest determinant of animals’ lives. Claims of animal protection, in the face of the growth and inequity driving the climate crisis, are some of the most falsifiable impact claims being made in philanthropy. Growth and inequity has done more to harm animals than those working in the field have done to save them.

Infographic from Fair Start Movement detailing how funding every child’s right to a fair start benefits children, climate, animals, democracy, and equality—with brief descriptions and relevant icons for each topic—while highlighting the need to avoid practices like legitimacywashing that can undermine genuine progress.

Is there a more macro way to think about animals?

Humans are animals. Seeing ourselves as such moves us away from anthrocentric thinking that ensured the climate crisis, and will kill millions. So, what we refer to as animal rights and law would focus on nonhumans not because of their species, but because of their unique vulnerability. In other words, animal law cannot merely be law that happens to refers to animals.

A more functional and less abstract form of animal law would have to start – as a first necessary condition –  with the capacity to actually protect nonhumans, especially in the creation of their relations with future humans who will determine much about their lives. Animal law in the best sense thus starts with inclusive birth and child welfare policies that create empathetic relations capable of benefitting animals. Nonhuman and human liberation are tied because the creation of our mutual relations is the biggest driver of outcomes.

    Climate crisis infographic

Neither business nor government has been historically tasked with defining the ideals of social justice. The wealthy families behind philanthropy generally did that, and in avant garde movements like animal rights and liberation. But by simultaneously individualizing the idea of reproductive autonomy to isolate women, evade child equity, and ensure unsustainable growth, they created a false reference point for self-determination- both for humans and animals.

The base – and in this case the base of what Brad assumed as a legitimate legal system – treated children of color as worth exponentially less investment in birth and development, and by fundamentally enabling growth, triggered a climate crisis killing some while enriching others.

This base has historically subverted the civil rights and anti-apartheid movements by undoing with family inequity upstream the good these families claimed to be doing downstream – a move that exponentially catalyzed the climate and related crises, while aiming the harm of the crises towards the least responsible for it and most vulnerable to it.

These unsustainable practices and systems ensured children entering under just thresholds, and thus overshoot of ecological carrying capacities, the degradation of those capacities, and the disempowerment of the average person to respond to the ensuing crises. They allowed wealthy white families to amass wealth, at illegal and deadly cost to generations of black families.

Activists now with the Fair Start Movement, in prior employment, had to omit facts that would have shown public interest information and interventions being vastly undone by growth and inequity. This was a charade of environmental sustainability and social justice that is still today being vastly undone every day as children enter the world without the resources they need. Activists working with fair start can literally attest to using wealth made at cost to their stated missions to drown out the voices of the vulnerable – especially communities of color –  who could actually accomplish the mission through more fundamental reforms.

If those Fair Start engages truly value the things (like animal rights) they took credit for protecting, they will be eager to now cover the costs to others of not having previously included the value in our basic language and systems of constitution and obligation, and to include these things they claim to value as we constitute relations going forward.

Fact: When impacts are correctly measured, not prioritizing a measurably fair start in life for all children did exponentially more harm to most stated missions of organizations than those organizations did good.

Intergenerational justice legitimates nations, making them capable of representing their constituents. We all do this together, by ensuring no child is born beneath a threshold of investment that would give them an influential equity stake in their democracies. Not having done this to date has condemned millions to die in a climate crisis, while the children of the wealthy families who benefited from illegitimacy have been enriched.

Two panels compare family planning types. Left: diverse family illustration with bright colors, labeled Fair Start family planning with positive points. Right: grayscale crowd in a city, labeled Economic growth-based family planning with negative points.

    Why Fair Start?

Funding that ensures no child is born beneath a set level of entitlement, consistent with the Children’s Rights Convention and Right to a Healthy Environment, is exponentially the most just and effective way to protect our future and free all of us. The creation of power relations – through birth, development, and emancipation – is usually the biggest driver of social justice outcomes because it operates on many levels, compounding impacts simultaneously.

Fair Start’s recent action before the United Nations asks anyone relying on any legal authority to derive back to the most preemptive source of legitimacy, an exercise that inevitably ends with the need to prioritize entitlements that would measurably empower all children through improved birth and development conditions, ensuring them a fair start in life and share equity in democracy.

Under the universally preemptive standard that ensures fair starts in life for all kids, we can remove extractive birth entitlements where children of color get a tenth or less of the wealth as white kids, are largely excluded from the political system, and bear the deadly cost of an ecocide they did not create.

By Intentionally Ignoring Growth and Inequity Nonprofits, Media and Business Leaders Created a Fantasy World of Progress That Prevented Real Climate Reforms, and Will Kill Millions

In this effort Fair Start is urging officials to contrast the claims of beneficial public impact being made by many entities and those they fund with actual harms to women and infants – correctly measured relative to a neutral position rather than the fictitious standards that created the climate and related crises.

Not omitting the impacts of children entering the world, admitting the use of failed and fraudulent standards, and inverting our obligation from the powerful to first women and children, can save both human and nonhuman lives.

TAKE ACTION: Urge Brad here to assess how children entering the world over the last several decades impacts his claims about the field of animal law, rights and protection, how that impact alters his legacy, and to consider how – in light of this factor – he would alter his advice to those he funded.
