FCC — A Tool for Spotting and Ending Illegal Discounting

Public-interest claims need legitimate valuation and reporting.

The Problem
Institutions regularly claim impact, equity, progress, sustainability, protection, justice, responsibility, or public benefit.

Those claims should be evaluated by determining whether the valuation and impact-reporting systems upon which they rely comply with an objective and legitimate standard. Without a clear threshold of empowerment, public-interest claims cannot be independently verified. They become value assessments without a measurable baseline.

The Central Question

Not simply good or bad.

The inquiry is not limited to whether a statement creates consumer confusion. It also examines the underlying system through which the claimant determines what counts as value, what counts as harm, whose interests are included, and whose lives are discounted.

The central question is not whether an institution is simply good or bad. The question is whether the institution’s claimed public benefit can be independently verified after accounting for the costs of equitably empowering children as they enter the world.

The Empowerment Principle

Fair Start’s theory begins with a distinction between words and actual power.

Constitutions, treaties, statutes, corporate charters, and other legal instruments describe rights, duties, institutions, and systems of authority. But words alone cannot ensure that people possess the practical capacity to exercise those rights, protect themselves, or participate as political equals. Legitimacy therefore depends not merely on what a legal document says, but on whether the system governed by that document actually empowers the people subject to it.

The Zero Baseline

The zero baseline represents the minimum position from which each child must be empowered before an institution may count additional activity as a public benefit. Benefits claimed above that line cannot legitimately be calculated by ignoring deprivation and disenfranchisement beneath it.

Why

Formal Rights Are Not Enough

If some children enter the world with overwhelming advantages while others enter beneath the conditions necessary for health, security, education, political influence, and self-protection, formally equal voting rights do not produce equal or influential political participation.

Illegal discounting is inseparable from racial and generational inequality.

If it is unlawful to operate a business model that expressly excludes people of color from employment or housing, institutional valuation systems should not be permitted to enrich some populations by imposing concealed, preventable, or deadly costs on children of color. A facially neutral calculation can preserve a race-based caste structure when it treats inherited deprivation as the baseline and counts benefits flowing primarily to already empowered groups without accounting for harms imposed on others.

The key harm is not limited to consumer confusion. It is the continued discounting and disenfranchisement of future lives, with disproportionate consequences for children of color and other populations positioned beneath the empowerment threshold.

Unfair Competition

Entities that accept the costs of legitimate valuation cannot fairly compete against entities that externalize those costs.

An institution that refuses to claim benefits without accounting for the equitable empowerment of children must bear costs that a noncompliant competitor can ignore. The noncompliant entity can report larger benefits, lower costs, stronger returns, and more favorable impact measurements because it has excluded the people and harms that would weaken its claims.

False Claims Checker describes this as a Ponzi-like or equity-fraud baseline: present legitimacy and value are claimed by shifting uncounted costs onto less empowered people and future generations.

Government Responsibility

Governments carry a corresponding obligation.

Governments create corporations, recognize nonprofit entities, enforce contracts, protect property, distribute public funds, provide tax advantages, regulate charities, and authorize institutional activity. Under Fair Start’s theory, those governmental actions carry a corresponding obligation to prevent state-created or state-protected entities from using valuation systems that depend upon the disenfranchisement of the people whose political equality legitimates governmental authority.

False Claims Checker develops evidentiary records that regulators, attorneys general, secretaries of state, journalists, researchers, donors, and affected communities can evaluate under the law governing each institution.

An Illustrative Application

It is less about the wording than the system.

An animal-protection leader may report “helping animals” based on particular campaigns, products, or policy changes. False Claims Checker would not stop after confirming that those activities occurred. It would examine whether the claimant accounted for the countervailing effects of inequitable population growth, consumption, habitat destruction, political inequality, and other systemic conditions materially affecting animals over the same period.

The review would then compare the claimed benefit with the material harm omitted from the claimant’s valuation. The same analysis applies to institutions claiming to protect children, reduce climate harm, advance racial equity, improve public health, strengthen democracy, or create sustainable value.

What Institutions Can Do

An institution whose claim is found noncompliant can:

Disclose the baseline used to assess value
Identify affected populations previously excluded
Measure countervailing and displaced harms
Account for future generations
Evaluate racial and generational disparities
Incorporate the costs of equitable childhood empowerment
Correct or qualify unsupported claims
Publish the data and methodology supporting revised claims
Adopt longitudinal accountability
Stop using claims that cannot be independently verified

The purpose is not merely to identify defective claims. It is to replace illegitimate valuation systems with measurable systems of empowerment.
